By renting a roll off dumpster from USA Grading, you (Customer) agree to:
Charges and Payment – Customer shall pay USA Grading for the collection and disposal of waste material. Additional charges may include any hand or machine removal of unaccepted materials, blocked containers, cancellation fee, trip charges (unable to perform service), and relocation fees (due to no fault of USA Grading).
Each of the above fees will be charged to the credit card on file promptly after service is provided. Any amounts billed and not paid in advance, must be paid by customer within ten (10) days after the date of invoice from USA Grading. USA Grading may charge, and customer agrees to pay a late fee no greater than that allowed by law on balances not paid within ten (10) days of the date of the invoice.
Waste Material – Customer represents and warrants that the materials placed in USA Grading’s equipment shall be waste material as defined herein and shall contain no other substances. The term “waste material” as used in this agreement shall mean solid waste generated by Customer excluding radioactive, explosive, highly flammable, biomedical, infectious, toxic, or hazardous material. The term “hazardous material” shall include but not be limited to any amount of waste listed or characterized as hazardous by the United States Environmental Protection Agency. Title to and liability for any waste excluded above shall remain with Customer and Customer expressly agrees to defend, indemnify and hold harmless USA Grading from and against any and all damages, penalties, fines and liabilities arising from waste excluded above, including allegations of USA Grading’s negligence.
Wait Fees – Customer agrees to pay for any extended (10 + minutes) wait times due to the following: blocked dumpster or delivery area, overloaded container, customer late for arrival, access to property (gates, etc.), any other wait times due to no fault of USA Grading. Customer agrees to pay $4.00 per minute after the allotted 10-minute grace period.
Driveways / Parking Areas – Customer agrees and warrants that any right of way provided by Customer for USA Grading’s equipment is sufficient to bear the weight of all equipment and vehicles required to perform the contracted service. USA Grading shall not be responsible for damage to any private driving surface, pavement or accompanying sub-surface of any route reasonably necessary to perform the service herein contracted and Customer assumes all liabilities for damage to driving surfaces, pavement or road surfaces and entire container placement site.
Lawn Areas – Customer agrees that USA Grading is not responsible for damage to lawns or yards or any other grass surfaces where a dumpster is being dropped.
Disclaimer – Customer agrees that USA Grading is not responsible for any damage to curbs, walks, wells, and septic systems. Customer is responsible for notifying USA Grading of any underground utilities which might be affected by taking delivery of the dumpster.
Delivery and Pick up – Delivery and / or removal of the dumpster is at the discretion of USA Grading’s driver. If the driver is unable to deliver or pick up a dumpster due to safety, inaccessibility, overweight container or overloaded container, the Customer shall pay a trip charge of up to $250.
Overloaded Containers – Customer agrees to not fill roll off dumpster above top rails. It is illegal to transport an over loaded dumpster and is also dangerous. USA Grading reserves the right to refuse pick up of any overloaded dumpster and Customer is responsible for any additional fees (up to $250) that may be incurred due to USA Grading’s inability to provide the scheduled service.
Equipment Care – The equipment furnished by USA Grading shall remain the property of USA Grading. Customer does agree that it has care, custody and control of USA Grading’s dumpster while at Customer’s location and accepts responsibility for any loss or damage to the equipment (except damage resulting from USA Grading’s driver negligence). Customer agrees not to overload, move or alter the equipment, and shall use the equipment only for its proper and intended purpose. Customer agrees to indemnify, defend and hold harmless USA Grading against all claims, damages, suits, penalties, fines and liabilities for injury or death to persons or loss or damage to property arising out of Customer’s use, operation or possession of the equipment, including allegations of USA Grading’s negligence.
Contamination – Customer agrees that there may be additional charges for the inclusion of any of the following unacceptable materials in dumpster.

- Hazardous Waste
- Medical Waste
- Chemical Products
- Pesticides
- Oil Filters
- Motor Oil / transmission oil/ hydraulic oil
- Fuel
- Industrial Waste
- Solvents
- Radioactive Material
- Paint (wet in can)
- Aerosol cans
- Antifreeze
- Tires
- Batteries
- Computers and Monitors
- Televisions
- Fluorescent bulbs / tubes
- Railroad Ties
- Animals
